What Is the Process for Registering a Land Share Agreement?
To execute a land share agreement in Bangladesh, the process begins with drafting a detailed agreement between the landowner and the developer. This agreement must clearly define all terms and conditions, including the share ratio of the developed property, project timeline, responsibilities of both parties, and procedures for resolving disputes. Once the terms are agreed upon, both parties sign the agreement.
The next step involves the Power of Attorney (PoA). In this phase, the landowner legally authorizes the developer to act on their behalf in matters related to the project. This includes applying for government approvals, overseeing construction, and in some cases, selling the developed units. The Power of Attorney must be both notarized and registered to be legally valid.
Before moving forward, a thorough verification of all land documents is essential. This includes checking the title deed, mutation record (Khatian), survey maps (RS, CS, BS), and land tax receipts. The objective is to ensure that the land is free from disputes, legal encumbrances, or ownership issues that could affect development.
Once verification is complete, the agreement and Power of Attorney must be registered with the Sub-Registrar’s Office under the Registration Act, 1908. This step formalizes the agreement and provides legal backing. Stamp duty and registration fees must be paid as per applicable rates.
Finally, the developer must obtain all necessary approvals from the relevant authorities. This includes building plan approval, zoning clearance, and environmental clearances where applicable. Additionally, the developer must secure utility connections for electricity, water, gas, and sewage systems to begin construction lawfully.
